5 18-12-2025 Earlier, the case was referred to the Mediation and Conciliation Center of Patna High Court, vide order No. 3 dated 01.09.2025 but as per Mediator’s Report dated 4.11.2025, mediation between the parties has failed.

Heard learned counsel for the petitioner, opposite party no. 2 and the State.

The petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 380, 504, 506, 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

As per prosecution case, all the named accused

persons including this petitioner tortured and harassed the complainant for non-fulfillment of demand of dowry.

It is submitted on behalf of petitioner that petitioner happens to be husband of the complainant and present case has been lodged due to petty family dispute. There is general and omnibus allegation of commission of assault against him. It is further submitted that petitioner is ready to keep the complainant, as his wife, with full honour and dignity. It is next submitted that the case is triable by the Magistrate. In this connection, petitioner has relied upon a judgment of this Court in the case of Md. Naimul Haque Ansari @ Naimul Haque Ansari & Ors. Vs. The State of Bihar , reported in 2006(3) PLJR 182 . He further submits that pursuant to order dated 22.1.2025 passed by the Principle Judge, Family Court, Kaimur at Bhabua in Matrimonial Case No. 227 of 2023, petitioner is already paying Rs. 5,000/- per month to opposite party no. 2 as interim maintenance, on or before 10^th day of every month (Annexure- P/3 to the supplementary affidavit).

Learned A.P.P. for the State as well as learned counsel for the opposite party no. 2 opposed the prayer for anticipatory bail of petitioner.

Considering the aforesaid facts and circumstances,

this anticipatory bail is allowed and it is ordered that let the above named petitioner, in the event of his arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Kaimur at Bhabua in connection with Complaint Case No. 531 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
