Heard learned counsel for the petitioner and learned

APP for the State.

The petitioners have preferred this application for grant of regular bail in connection with Bhalpatti P.S. Case No. 129 of 2024 registered for the offences punishable under Sections 331(4) and 305 of the B.N.S.

As per the prosecution story, the informant has

alleged that some unknown thieves have stolen jewellery from

his house worth Rs. 8-10 lakh as well as new clothes worth Rs. 50,000/- as he was not present in his house.

Learned counsel for the petitioners submit that the petitioners are innocent and has falsely been implicated in this case due to greedy intention of the informant and Police. These petitioners are not named in the F.I.R. rather the F.I.R. has been lodged against unknown. The petitioners were not apprehended on the spot. During the course of investigation, on indication of the spy, name of these petitioners came in picture and they have been made accused in this case. Nothing incriminating has been recovered from the conscious possession of the petitioners. The antecedent of the petitioners is clean and they are in custody since 23.12.2024.

Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Keeping in view the aforesaid facts and considering the period under custody, let the petitioners, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Bhalpatti P.S. Case No. 129 of 2024 subject to the following conditions :-

(i). Petitioners will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioners may be cancelled by the Trial Court.
