2 28-04-2025 Heard learned counsel for the petitioner, lerned counsel for the informant and learned APP for the State.

The petitioner has prayed for bail a case in connection with Bettiah Town P.S. FIR No. 773 of 2020 registered for the offence punishable under sections 316(2), 318(4), 338, 336(3), 340(2) of the Bharatiya Nyaya Sanhita, 2023 corresponding to Sections 406, 420, 467, 468, 471/34 of the IPC and Section 138 of the Negotiable Instrument Act.

As per allegation in the FIR, petitioner along with other three accused persons has offered the informant to provide job in Health Department to her husband for which they have

misappropriated an amount of Rs. 10,00,000/- (ten lac). Accused persons also provided a forged appointment letter to the informant. It is further alleged that informant had deposited Rs. 4 lac in petitioner’s account. Later on petitioner returned the amount by issuing a cheque but due to insufficient fund, the same was dis-honoured and thereafter the present case.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has got no criminal antecedent and languishing in judicial custody since 25.08.2024.

In para 11 of the petition, it is admitted fact that informant had given Rs. 4 lac in the petitioner’s account. Out of Rs. 4 lac, petitioner has returned RS. 60,000/- to the informant and supporting document is annexed as Annesure-3 to the petition.

Learned counsel for the petitioner on instructions, submits that and petitioner is ready to return the remaining amount i.e. 3,40,000/- to the informant within a period of six months after his release. He also assures that he will pay first installment of Rs. One lac at the time of filing bail bond.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts the petitioner is ready to return the amount to which he had received, this court is inclined to enlarge him on provisional bail. The above named petitioner is directed to be enlarged on provisional bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran at Bettiah in connection with Bettiah Town P.S. FIR No. 773 of 2020 subject to condition that at the time of filing bail bond, petitioner will produce the first deposit receipt of Rs. 1,00,000/- (Rs. One lac)/- to the informant’s account.

Trial Court is directed to confirm the provisional bail granted to the petitioner after verifying the six deposit receipts of payment of the entire amount i.e. Rs. 3 lac and forty thousand/- (Rs. three lac and forty thousand) by the petitioner to the informant.

Accordingly, the instant application stands disposed
