Heard learned counsel for the petitioner; learned counsel for the informant and learned A.P.P. for the State.

The petitioner seeks bail in connection with Krishnagarh P. S. Case No. 129 of 2024, dated 30-11-2024 instituted for the offence punishable under Sections 126(2),115(2),352, 109, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in brief, is that on 27.11.2024 at around 6:30 PM, while the informant was returning home from her agricultural field, the petitioner along with co-accused Baleshwar Mahto, Umesh Singh, Arvind Kumar Singh @ Suraj Kumar confronted her and began abusing her over the

harvesting of paddy. When the informant objected, all the accused persons assaulted her husband, Akhilesh Kumar Singh, with lathi on his head, as a result of which, he fell unconscious. It is further alleged that during the incident, co-accused Baijanti Devi and Pawan Kumar Singh arrived and also assaulted them with lathi-danda . When the informant’s devar (brother-in-law), son, daughter, nephew, and niece came to save them, they too were assaulted. It is also alleged that co-accused Anita Devi and Gayatri Devi not only assaulted them but also snatched Rs. 5,000 /-from the pocket of the informant’s husband. The injured were taken to Sadar Hospital for treatment, from where her husband was referred to P.M.C.H. for better treatment.

Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is submitted that the FIR has been lodged against eight accused persons, including the petitioner. The allegation is that the petitioner, along with co-accused Baleshwar Mahto, Umesh Singh, and Arvind Kumar Singh @ Suraj Kumar, assaulted the informant’s husband on the head, causing head injury. It is further submitted that a similarly situated coaccused, namely Baleshwar Mahato @ Baleshwar Singh, has been granted anticipatory bail by a Co-ordinate Bench of this

Court vide order dated 19.04.2025, passed in Cr. Miscellaneous No. 19201 of 2025. Learned counsel further submits that there is no specific allegation against the petitioner rather, the allegations made are general and omnibus in nature, attributed against all the accused persons. The charge sheet has already been submitted in the case. The petitioner has been in custody since 11.02.2025 and has no criminal antecedents.

Learned counsel for the informant and learned A.P.P. for the State have opposed the prayer for bail. It is submitted that the petitioner, along with the other co-accused persons, assaulted Akhilesh Kumar Singh on the head, causing grievous injuries with a hard and blunt object.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara, in connection with Krishnagarh P. S. Case No. 129 of 2024.
