The petitioners apprehend arrest in connection with Palasi PS Case No.103 of 2024 dated 22.03.2024, instituted for the offence punishable under Sections 341, 323, 307, 504, 354B of the Indian Penal Code.

The allegation against the petitioner no.1 is that he assaulted the husband of the informant on his head by means of sword; against petitioner no.2 is that he disrobed the informant and assaulted Gokul Yadav with farsa on his head and against petitioner no.3 is that he assaulted Ram Krishna Yadav on his

head by means of iron rod.

Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. It is further submitted that both sides are agnates and occurrence took place on account of grazing of grass by the goats. Further submission is that allegation against petitioner no.1 is that he assaulted the husband of the informant on his head by means of sword but the injury report of husband of the informant which is available in para 29 of the case diary shows that he sustained simple injury caused by hard and blunt substance. There is no injury report of other injured available in the case diary. It is also submitted that due to intervention of well wishers and family members both sides have compromised the matter and a compromise petitioner has been filed in the Court below. Lastly, it is submitted that the petitioners have no criminal antecedents.

Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with

two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in Palasi PS Case No.103 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023.
