Heard learned counsel for the petitioner and learned

A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Jandaha P.S. Case No. 485 of 2024 dated 19.12.2024 registered for the offences punishable u/s 126(2), 115(2), 329(3), 324 (4), 103, 61(2) read with section 3(5) of the BNS.

As per the prosecution case, the petitioner along with other co-accused persons assaulted the father of the informant while he was protesting the cutting of trees on his land due to which his father became unconscious and died.

Learned counsel for the petitioner has submitted

that the petitioner is innocent and has falsely been implicated in this case due to land dispute between the parties. He further submits that the father of the informant died due to cardiac arrest which is evident from post-mortem report (Annexure-2) of the deceased. There is no external injury present over the body. It is further submitted that the FIR was lodged after delay of two days of the alleged occurrence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.12.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 485 of 2024.

The application stands allowed.
