Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 559 of 2024 arising out of Madhubani P.S. Case No. 48 of 2024 registered for the offence punishable under Section 302 of the Indian Penal Code.

As per the prosecution case, on 28.06.2024, the petitioner entered the house of the informant and wanted to establish physical relation with her daughter as she was alone in the house. On refusal of the victim, the petitioner committed murder of the minor daughter of informant and hanged her dead body with dupatta to give colour of suicide.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner and informant are agnates and there is land dispute between the parties. The police after investigation submitted charge-sheet against the petitioner under Section 306 of the IPC. He further submits that there is no eye witness to the alleged occurrence and there is no sign of rape in post -mortem report. The petitioner is in judicial custody since 11.09.2024 having one criminal antecedent in which he is on bail.

Learned APP for the State has vehemently opposed the bail petition of the petitioner and submits that there is specific allegation against the petitioner. The doctor found that the cause of death of the deceased is asphyxia and shock due to ante - mortem hanging which raised suspicion against the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the specific allegation levelled against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Madhubani P.S. Case No. 48 of 2024, pending in the Court of learned 2^nd Additional Sessions Judge, Purnea.
