Heard learned counsel for the petitioner, informant

and learned A.P.P. for the State.

Petitioner apprehends arrest in case registered for the offences punishable under Sections 376, 406, 420, 506 of the Indian Penal Code.

As per prosecution case, this petitioner committed

rape upon the informant and her mother on pretext of arranging bail for her father and brother and also usurped the ancestral land and jewellery of the informant.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, mother of the informant purchased two pieces of land

which was fraudulently sold to the petitioner and present false case has been lodged against petitioner in order to grab the money from him. Rest of the allegations are ornamental only to make the case grave. Petitioner claims clean antecedent.

However, learned counsel for the informant vehemently opposed the bail application and submitted that victim in her statement recorded under Section 183 BNSS has supported the prosecution case and during course of investigation it has come that this petitioner also stayed with the informant and established physical relationship with her.

In view of the gravity of the offence and statement of the victim recorded under Section 183 BNSS, prayer for anticipatory bail of the petitioner is refused.
