2. The petitioner has preferred this application for grant of regular bail in connection with Kharagpur P.S. Case No. 111 of 2024 dated 29.03.2024 registered for the offences punishable u/ss 366A of the Indian Penal Code. Further, after investigation, Charge-sheet bearing Charge-sheet No. 269/2024 has been submitted on 31.08.2024 and Section 376 of the I.P.C. along with Sections 4 and 8 of the POCSO Act and Section 9 of the Prohibition of Child Marriage Act were added.

3. As per the prosecution case, the petitioner is alleged to have kidnapped the minor daughter of the informant

on a motorcycle. It is further alleged that when the informant along with many people reached the house of the petitioner and told the entire story to his parents but the parents of the petitioner threatened and said that they have no knowledge about the incident.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is a delay of two days in lodging the F.I.R. without any explanation. There was love affair between the victim and the petitioner. The victim in her statement recorded u/s 164 of the Cr.P.C. has stated that she voluntarily left her home and went to Kolkata with the petitioner and solemnized marriage there. The victim also stated that they stayed at Kolkata happily for about three months. The petitioner is a married person having daughter of three years old as stated in para 17 of the bail petition. The charge-sheet has been submitted against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.08.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the victim is a minor girl.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Munger in connection with Kharagpur P.S. Case No. 111 of 2024.
