Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Sonepur P.S Case No. 94/2023 dated 09.02.2023 registered for the offence punishable u/s 341, 326, 307 and 120B read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have fired on the informant's brother causing firearm injury. Thereafter, the injured was taken to hospital for treatment. The reason behind the said occurrence is alleged to be land dispute.

that the petitioner is innocent and has falsely been implicated in this case. The other co-accused person has already been granted anticipatory bail by this court vide order dated 26.02.2024 passed in Cr. Misc. No. 75614/2024. There is no specific overt act against the petitioner. There is no independent witness of the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner. As per para. 16 of the case diary, the injured Prince Kumar in his statement has stated that on the date of occurrence, the petitioner and the co-accused persons came to the kiosk holding pistol and fired two shots on him due to which he received gunshot injuries. As per the Injury Report, four injuries are found on the person of the injured out of which injury no. 2 is grievous in nature.

6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, I am of the view that no case for grant of anticipatory bail is made out. The petition is rejected and the petitioner is directed to surrender to the Court below within six weeks from the date of this order and the Court below may consider the
