Heard the learned counsel for the appellant as well as the learned counsel for the respondents.

This appeal has been preferred against the judgment and order dated 18.05.2022 passed by Shri Shiv Chandra, learned Additional District and Sessions Judge-l Special Judge, Madhubani in C.I.S. NO 67/2017 (arising out of SC/ST Madhepura P.S. case No. 10/2016 dated 18.05.2022) whereby and whereunder the learned trial court has been pleased to acquit the accused-Respondents No.2 to 5 from the charges leveled against them under Section 3(1)(s) of SC/ST Act.

The brief facts of the case are that the informant, Rubi Devi, who was claiming herself to be a member of the Scheduled Caste, made allegations that she was working as a maid

in the house of Sai Ishlam (Respondent No. 2). Sai Ishlam did not pay her wages, and he and his family members assaulted her and abused her by calling her caste name.

During the trial, it was detected that the husband of the informant was an accused in a case of kidnapping of son of respondent No. 2. The learned court below came to the conclusion that when the husband of the informant was an accused in a case lodged by respondent No. 2, it appears prima facie unbelievable that the appellant/informant might have worked as a maid in the house of the person, who implicated her husband in case of kidnapping of his son.

The learned court below disbelieved the prosecution case and acquitted Respondent No. 2 of all the charges leveled against him.

I do not find any infirmity in the impugned judgment and order dated 18.05.2022 passed by the learned Additional District and Sessions Judge-cum-Special Judge-I, Madhepura in CIS No. 67/2017. Accordingly, this appeal is dismissed.
