Patna High Court (Division Bench: Bibek Chaudhuri and Dr. Anshuman, JJ; order per Bibek Chaudhuri, J, dated 16-09-2025) disposed of Criminal Appeal (DB) No.693 of 2017, Deepak Pandey v. The State of Bihar, arising out of PS Case No.3 of 2006, Karahgar police station, District Rohtas. By order no.19 dated 24.06.2025 the Court had remanded the matter to the Juvenile Justice Board, Rohtas at Sasaram to pass appropriate orders on the appellant's detention and custody under the Juvenile Justice (Care and Protection of Children) Act. In compliance, the Board reported that the occurrence arose out of a land dispute; the child in conflict with law had undergone two years four months and twenty-three days in judicial custody, regretted his past conduct, was now a major employed as a government teacher, and had been unanimously released on probation of good conduct for six months under Section 15(1)(f) of the Juvenile Justice (Care and Protection of Children) Act, 2000, with supervision by the Legal cum Probation Officer and discharge of his sureties. Accepting the Board's report, the Court disposed of the appeal.

The instant appeal has been listed today under the heading ‘For Orders (On Office Notes)’.

Upon perusal of the records, we find that v ide order no.19 dated 24.06.2025, the matter was remanded back to the Juvenile Justice Board, Rohtas at Sasaram to pass appropriate orders regarding the detention and custody of the appellant namely, Deepak Pandey in accordance with the provisions of the Juvenile Justice (Care and Protection of Children) Act. The Juvenile Justice Board in compliance of the Court’s order has passed order and submitted a report before this Court. The operative part of the said order passed by the Juvenile Justice Board states as follows:-

“After hearing of both the sides and sincere perusal of case record as well as Social Investigation Report it is clear that the occurrence was happened in this case due to land dispute. The child in conflict with law namely Deepak Pandey has spent the detention period i.e., two years four months and twentythree days in the judicial custody and he regrets his past conducts and he is currently appointed as a government teacher and now he is a major. It is therefore child in conflict with law Deepak Pandey has already been rehabilitate and he wants to make his future bright hence no issues regarding rehabilitation, therefore, in his best interest and under such circumstances unanimously the board is of the view that he must be given an opportunity to join the main stream of society. Hence the child in conflict with law Deepak Pandey is hereby released on probation of good conduct as per Section 15 (1) sub-clause (f) of the Juvenile Justice (Care and Protection of Children) Act, 2000, for the period of six months and the Legal cum Probation Officer is directed to supervise the child in conflict with law Deepak Pandey and submit his report before the board. The child in conflict with law Deepak Pandey is on bail. His sureties are also discharged from their liabilities under their respective bail bonds.
