The petitioners were recommended for the post of SubInspector of Police under the Scheme of “Bihar Outstanding Sportspersons Direct Appointment Rules, 2023” as they took part and secured medals in the National Game of Ju-jitsu Senior National Championship, held at Devas, Madhya Pradesh on 30^th March, 2023. After recommendation, the respondent nos. 1 to 5 enquired into the veracity of claim of the petitioners with regard to their taking part in National Championship of Ji-jitsu Game and initially it was informed by the Ji-jitsu Association of India, by e- mail, on 5^th January, 2024, that the petitioners did not take part in the National Championship of Ji-jitsu, held on 30^th March, 2023. On the basis of e-mail sent by the Secretary General, Ji-jitsu Association of India, the recommendation for appointment as SubInspector of Police in favour of the petitioners were withdrawn.

It is found from the order dated 30^th April, 2024, issued by the Deputy Secretary, General Administration Department, Government of Bihar that Ji-jitsu competition is organized by one and only Association, namely Ji-jitsu Association of India duly recognized by the Ministry of Interfere and Sports, Government of India and affiliated to Ji-jitsu International Federation and Ji-jitsu Asia Union. However, Ji-jitsu Association of India did not produce any document relating to tie-sheet,

complete result chart, medal ceremony etc., in support of the claim of the petitioners that they participated in the National Game of Jijitsu Competition and secured medals in the said Game, held on 30^th March, 2023 at Devas, Madhya Pradesh. The Deputy Secretary, General Administration Department in his report held that the Ji-jitsu is not a recognized Game. The Association did not produce any videography of the competition or medals distribution ceremony to prove that the petitioners took part in the said Game. Therefore, the petitioners claim that they secured medals in National Championship of Ji-jitsu Game was held to be false and concocted, as a result, recommendation for Government job was recalled by the respondents.

Mr. Ramakant Sharma, learned Senior Counsel takes me to Annexure-P/3 series at page 29-32, issued by the Secretary General, Ji-jitsu Association of India, dated 20^th January, 2024 in favour of the Director, Bihar State Sports Authority, stating, inter alia, that the petitioners took part in the National Competition of Ji-jitsu Game held on 30^th March, 2023 at Devas, Madhya Pradesh and secured medals in the National level competition. It is submitted by him that the letter dated 20^th January, 2024 being the subsequent letter ought to be accepted to be true and if such letter

was accepted, the recommendation of Government service in favour of the petitioners might not have been withdrawn.

The State respondents, specially the respondent nos. 2, 5 and 6 filed counter affidavit and supplementary counter affidavit denying the claim of the petitioners and stating that the Association confirms that the petitioners did not participate in the National Game and their so called certificates and medals were false and forged. They are not entitled to be recommended for Government service in Police Department.

Today, at the time of hearing, the respondent nos. 2, 5 and 6 have filed second supplementary affidavit, stating, inter alia, that in view of the contradictory certificates received by the Bihar State Sports Authority from the Ji-jitsu Association of India, the respondents formed four men Committee, headed by the Directorcum-Secretary to enquire into the question as to whether the petitioners took part in Ji-jitsu National Competition, 2023, held in Devas, Madhya Pradesh or not. I have heard the learned Senior Counsel on behalf of

the petitioners and the learned Advocate on behalf of the contesting respondents.

It is submitted by the learned Senior Counsel on behalf of the petitioners that the petitioners took part in National Game of Ji-jitsu in the year 2023 and they secured medals. In support of their claim, they have filed the certificates issued by the Ji-jitsu Association of India and their medals before the respondent authority. It is not within the scope of the petitioners to produce further proof in the form of photographs, videography etc. because the players are not supposed to take photograph and videography at the time of their Game/Tournaments. The petitioners’ recommendation for service cannot be withdrawn on the ground that Ji-jitsu Association of India failed to produce photographs, videography and other documents to prove that the petitioners have participated in the said sports.

It is also submitted by the learned Senior Advocate on behalf of the petitioners that the letter dated 20^th January, 2024 written by the General Secretary of the Ji-jitsu Association of

India, ought to be considered as the final proof of petitioners’ participation in the said Game.

I have duly considered the submissions made by the learned counsel for the parties.

This Court is of the view that while the outstanding sports persons are interested of Government job by the State of Bihar under “Bihar Outstanding Sportspersons Direct Appointment Rules, 2023”, the Bihar Sports Authority is very much entitled to enquire into the veracity of the claim of the petitioners because the petitioners are recommended for responsible Government service only due to their proficiency in Sports and Games. This is not general recruitment. The outstanding sports persons in the State of Bihar are recommended for Government job as a special measure to encourage them and young men and women of the State in Sports and Games in general. It is found from the record, specially the supplementary counter affidavit that the Bihar State Sports Authority enquired into the matter at least twice and received contradictory opinion from the Ji-jitsu Association of India in respect of participation of the petitioners.

For the reasons stated above, this Court is of the view that since the Ji-jitsu Association of India is recognized by

the Ministry of Youth Affairs and Sports, Government of India & Olympic Council of Asia, an enquiry ought to be conducted by the Ministry of Youth Affairs and Sports, Government of India to ascertain as to whether the petitioners took part in Ji-jitsu National Championship of 2023 and submit its report within 90 days from the date of this order.

The enquiry report submitted by the Ministry of Youth Affairs and Sports, Government of India shall be held to be final both by the petitioners and the respondents authorities.

The respondents shall act in accordance with the report submitted by the Ministry of Youth Affairs and Sports, Government of India & Olympic Council of Asia.

Both the petitioners as well as the Bihar State Sports Authority shall submit/send all necessary documents along with a copy of this order to the Secretary, Ministry of Youth Affairs and Sports, Government of India for holding enquiry either by himself or by any other competent Officer under his control not below the rank of the Deputy Secretary to ascertain the rival claims of the petitioners and the respondent nos. 2, 5 and 6.

The enquiry report shall be submitted to the Bihar State Sports Authority within 90 days from the date of communication of this order.
