In the instant revision, quantum of maintenance

passed in Maintenance Case No. 20 of 2013 on 17^th of May, 2018, by the Principal Judge, Family, Court at Bhojpur is under challenge on the ground that the petitioner has no financial capacity to maintain his wife and minor child.

It is the case of the Opposite Party No. 2/wife that the petitioner has a shop and he earns Rs. 9,000/- per month. The petitioner, on the other hand, pleaded that he has no shop and there is of course a shop in the name of his father. He does not have any regular income.

On the basis of the said pleading, both the parties led evidence before the Trial Court. The learned Trial Judge on appreciation of evidence made the following findings:-

"ददोननों पकनों दद्वारद्वा प्रस्त त ु सद्वाकनों कक वविश्लकषण सक स्पष्ट हह वक वबिहद्वाररी वमिल पर वविपकरी करी वकरद्वानद्वा ददकद्वान हह तथद्वा अन्य सदोतनों सक भरी उसक आय कद्वा सद्वाधन हह। 10-15 आविकवदकद्वा करी ओर सक यह कहद्वा गयद्वा हह वक हजद्वार रूपयक करी प्रवतवदन आमिदनरी वकरद्वानद्वा ददकद्वान सक हह। इस सभद् व ानद्वा सक इनकद्वार नहहीं वकयद्वा जद्वा सकतद्वा वक आविकवदकद्वा ददकद्वान मिमें वबिकरी करी गई रद् व ाशि और लद्वाभ मिमें फकर्क न जद्वानतरी हदो। यवद उक्त रद् व ाशि कदो वबिकरी रद् व ाशि भरी मिद्वान वलयद्वा जद्वाए तदो भरी वविपकरी कद्वा प्रवतवदन हजद्वार डकढ हजद्वार रूपयक सक अवधक करी आय हहैं तथद्वा विह एक सद्वाधन सम्पन्न व्यवक्त हह।"

The learned Trial Judge also found that unless the petitioner has no sufficient means to maintain his wife, he had not married another lady for the second time. Second marriage of the petitioner is admitted fact.

In view of such circumstances, accepting the evidence of the petitioner on the principle of preponderance of probability, I do not find any reason to interfere over the impugned order.

Accordingly, the impugned order is affirmed and the revisional application is dismissed.
