Heard learned counsel for the petitioner and the State.

The petitioner seeks regular bail in a case registered for the offence punishable under sections 365, 302, 201, 120B/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused Anil Kumar was threatening son of the informant on mobile and later on, the accused persons disappeared son of the informant and during course of investigation, his dead body was recovered.

Learned counsel for the petitioner submits that informant is not an eye witness of the occurrence and petitioner has been made accused only on suspicion. Petitioner is in custody since 2.9.2023 and charge sheet has already been

submitted.

However, learned counsel for the informant and State vehemently opposed the bail application and submitted that there is specific allegation against the petitioner that he along with one other accused person was threatening the deceased on mobile phone as to why he was talking to wife of co-accused Anil Kumar. Motorcycle of the victim was recovered from Bariyahi Ghat Bridge in abandoned condition.

Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rosera, Samastipur in Hathauri PS Case No. 141 of 2023.
