2. The petitioner has preferred this application for grant of regular bail in connection withKanti P.S. Case No. 773 of 2023 dated 03.10.2023 registered for the offence punishable u/ss 354B, 354C, 354D and 506 of the Indian Penal Code, Sections 8 and 10 of the POCSO Act and Section 67(a) of the I.T. Act.

3. As per the prosecution case, when the informant was returning from coaching and the informant's phone fell on the way. After calling on the number, the petitioner picked up the call and told her that he found the phone on the road.

Thereafter, the petitioner returned the informant's phone after three days, after checking the informant's photos, contacts and other details were not there and phone was empty. Further, the petitioner made obscene photos of the informant and made it viral on social media platforms. Thereafter, the petitioner made a written agreement to remove all the obscene photos. Further, the petitioner has stated that he has a gang involved in bank robberies, cyber crimes and other criminal activities and threatened to do anything to the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has neither made any photos of the informant viral nor he has demanded any money from anyone. Learned counsel has submitted that the prosecution story is false and concocted. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.10.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond

of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with Kanti P.S. Case No. 773 of 2023.
