Heard learned counsel for the petitioners and Mr. Anil Kumar, learned APP for the State.

The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Sasaram Town Model P.S. Case No. 668 of 2024 instituted for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 303(2), 74, 329(4), 351(3) of the B.N.S.

The case of the proseuction is that the petitioners

along with others armed with lathi , danda , gadasa and bhala arrived at the door of the informant started abuisng and assaulted him. It is further alleged that petitioner Paras Chaudhary assaulted with Gadasa on the head of the informant due to which

he sustained injury.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case due to land dispute between the parties. There is case and counter case between both the parties. It is further submitted by learned counsel for the petitioners that from perusal of the injury report, it is clear that the informant has received head injury but the nature of injury is simple. It is also submitted by learned counsel for the petitioners that in this alleged occurrence, both parties have sustained injuries. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Other co-accused persons have already been granted bail by this Court vide order dated 25.10.2024 in Cr. Misc. No 70361 of 2024.

Learned APP for the State has opposed the prayer of bail of the petitioners.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Sasaram Town Model P.S. Case No. 668 of 2024,

they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each of them with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Sasaram, Rohtas subject to the conditions as laid down under section 438(2) of the Cr.P.C.
