Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the complainant / opposite party no. 2.

The petitioner apprehends his arrest in complaint case punishable for the offence under Sections 498A, 494, 406, 420 of the Indian Penal Code and Sections 3 /4 of the Dowry Prohibition Act.

It is a case of ‘Matrimonial Dispute’. Petitioner, who is husband of the complainant/opposite party no. 2, is alleged to have committed torture with opposite party no. 2 for dowry.

Learned counsel for the petitioner, by way of filing supplementary affidavit, submits that pursuant to order dated

12.07.2022 passed in Divorce Case No. 174 of 2018, whereby, Rs. 4000/- per month is to be paid to opposite party no. 2, as interim maintenance, the petitioner has paid total sum of Rs. 88,000/- to opposite party no. 2 till the period of April, 2024. Petitioner also undertakes to make payment of interim maintenance amount regularly to opposite party no. 2.

Learned counsel for the opposite party no. 2 does not dispute the aforesaid payment.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Vaishali at Hajipur in connection with Complaint Case No. 177 of 2022, corresponding to Trial No. 2448 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
