Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Khaira P.S. Case No. 388 of 2023 for the offences registered under Sections 30(a) of the Bihar Excise (Amendment) Act.

As per the prosecution case, there is recovery of 20 litres country made liquor near Radha Bagi canal. Name of the petitioner has been disclosed by the local Chaukidar that they have fled away from the spot.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to two criminal antecedents. Petitioner was not arrested from the spot but due to village politics his name has been surfaced without any basis. No incriminating material has been

recovered from the conscious possession of the petitioner. He is in custody since 01.11.2023.

Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Khaira P.S. Case No. 388 of 2023.
