Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 342, 323, 354(B), 504, 506 and 34 of the Indian Penal Code.

As per F.I.R., petitioner no. 1 is registered owner of “ Sanjana Raj Musical Arkestra Dance Group ” and petitioner no. 2 is his wife and it is alleged that informant has worked in the said Dance Group for five months and thereafter, rest of the period in the home of petitioners, as maid-servant, but these petitioners did not pay her any wages and when informant demanded her wages, she was abused and assaulted by these petitioners.

It is submitted on behalf of petitioners that petitioners have falsely been implicated and no such occurrence, as alleged in the F.I.R., took place. As a matter of fact, the informant approached the petitioners to join the dance group, but the petitioners did not allow her to join dance group and just to wreck vengeance, this false and concocted case has been lodged by her. Petitioners claim clean antecedent.

Learned A.P.P. for the State has opposed the bail

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Sugauli P.S. Case No. 406 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
