Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 120B of the Indian Penal Code.

According to F.I.R., this petitioner, in conspiracy with other accused persons, executed forged and fabricated sale deed in favour of co-accused Meena Devi without any right and title over 4 dhur land of informant.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner is only alleged to be deed writer of the said sale deed. He is neither

purchaser nor seller or beneficiary of the land in question. Petitioner has got clean antecedent.

Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya (Banjariya) P. S. Case No. 229 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
