The petitioners are seeking regular bail in connection with Rajepur P.S. Case No. 127 of 2021, registered for the offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

As per allegation, the accused persons named in the FIR including the petitioners surrounded the informant and his father and they forcibly took away his father to village Kashi Pakri. The informant became successful in fleeing away. The accused persons badly assaulted the informant’s father, who died during course of treatment.

The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The deceased had committed dacoity in several houses. He has further submitted that the petitioners are the persons of clean antecedents. The petitioners are under custody since 02.04.2024, 14.04.2024 and 08.04.2024 respectively. He has also submitted that on exactly similar footing, co-accused has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. Nos. 1709 of 2022 and 2511 of 2022.

Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on

bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Rajepur P.S. Case No. 127 of 2021, subject to the condition that the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the Court.
