Heard learned counsel for the petitioner, the

learned counsel appearing on behalf of the informant and learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 307, 341, 323, 379, 504, 506 and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that on account of dispute relating to land, Sonu assaulted Ashish by an iron rod causing fracture of bone and he fell. Thereafter, Suresh and Vikash assaulted Ashish, but on alarm, they fled.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that specific allegation of assaulting Ashish causing fracture his collar bone is against Sonu and petitioner, being father of Sonu, came to be implicated with general and omnibus allegation of assault.

Learned A.P.P. as well as the learned counsel appearing on behalf of the informant opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Bhojpur at Ara in connection with Shahpur P. S. Case No.82 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
