Heard learned counsel for the parties.

The petitioner has preferred this application for

grant of regular bail in connection with Raniganj P.S. Case no.450 of 2023 registered under section 392 of the Indian Penal Code.

As per the prosecution case, while the informant was coming on his motorcycle, three accused persons on a motorcycle dashed the vehicle of the informant and looted the informant of Rs.1.91 lacs in cash besides his mobile phone etc. as mentioned in the FIR.

Learned counsel for the petitioner submits that the FIR was registered against three unknown accused persons. The name of the petitioner transpired in the confessional statement of co-accused made before police. No incriminating article has been recovered from the petitioner’s possession. Inspite of the

petitioner being in custody since 23.2.2024, he has not been put on TI parade and charge-sheet has been submitted in the case.

The application for bail is opposed by learned A.P.P for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the contents of the order of the learned trial Court, no incriminating article having been recovered from the petitioner’s possession, his not having been put on TI parade inspite of being in custody since 23.2.2024 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Raniganj P.S. Case no.450 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Araria.
