Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek regular bail in connection with Sitamarhi P.S. Case No. 821 of 2023 registered for the offence under Sections 307 and 120B of the IPC and Section 27 of the Arms Act.

The prosecution case in brief is that Ravi Pathak, Head of Department, Physics who is also In-charge of Chemistry Department and on 31.10.2023 one person came in the room of Physics Department and fired on the head of Ravi Pathak with an intention to kill due to which Ravi Pathak sustained injuries on his head and face. After firing, the said

person fled away.

Learned counsels for the petitioners have stated that the petitioners are quite innocent, committed no offence and have falsely been implicated in the present case. The petitioners are employees of the same college and the petitioners are implicated in this case only on the basis of suspicion. Petitioners are in custody since 4.11.2023.

The learned APP for the State vehemently opposed the prayer for bail of the petitioners.

On perusal of FIR, case dairy, injury report and impugned order, it appears that on the basis of fardbeyan, FIR was registered under Section 307 and 120B of the IPC and 27 of the Arms Act against unknown persons. It also appears that during course of investigation, the name of the petitioners transpired on the basis of suspicion. It also appears that the informant is also lab boy/technician of the Radha Goenka College and all the accused persons are staff of the said college but the informant is not named by the said accused persons.

Considering the aforesaid facts and circumstances of the case, let the above named four petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of
