The petitioner has moved the Court for the

following reliefs:

“That this application is being filed for quashing of the order dated 17.01.2024 passed by the Additional Sessions Judge-II, Begusarai in Sessions Trial No. 708/2011 arising out of Nayagaon P.S. Case No. 64/2010 whereby and where under the learned court below has rejected the application dated 09.10.2023 filed by the prosecution for amendment of charge only on the ground that the petition has been filed at belated stage without considering that the F.I.R was registered under Sections 147, 148, 149, 341, 323, 307, 504 of the Indian Penal Code read with Section 27 of the Arms Act and accordingly the charge sheet was also submitted under the same sections but the learned court below has framed

the charges under Section 27(2) of the Arms Act along with other Sections of the Indian Penal Code without considering that the F.I.R was not registered under Section 27(2) of the Arms Act along with other Sections of the Indian Penal Code nor charge sheet was submitted.”
