2 15-05-2024 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing for the State.

In the present case, the petitioners are apprehending

their arrest in connection with Shikarpur P.S. Case No. 640 of

2021 registered on 13.11.2021 for the offences under Sections 147, 148, 149, 447, 341, 323, 324 and 307 of the Indian Penal Code.

As per the prosecution case, the petitioners armed

with lathi, fatha, bhala and garasa came to the doors of the informant and started assaulting them. Four persons from the informant side received injuries in the hands of the assailants.

Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. The present case is counterblast of Shikarpur P.S. Case No. 639 of 2021 filed by petitioner no. 3 under section 307 and other allied sections of the Indian Penal Code. In retaliation thereof the present case has been lodged. The persons from petitioners side have received injuries for which there is no explanation and informant and others are the assailants. Learned counsel further submits that injury report of the victims of this case show simple injuries while one grievous injury has been found on Lalan Manjhi. Good sense has prevailed between the parties and they have arrived at compromise amongst them and a compromise petition has been filed before the Court of learned District & Sessions Judge, Bettiah, West Champaran. Learned counsel further submits that the petitioners have got no criminal antecedent.

Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioners. Learned A.P.P. for the State submits that both persons received injuries in the

assault of the petitioners.

Having regard to the fact and circumstances and submission made on behalf of the parties and also considering case and counter case between the parties and further considering mostly simple nature of injury of the victims and general and non-specific allegation against the petitioners, let the petitioners above named, in the event of their arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 640 of 2021, subject to the condition laid down under Section 438(2) of the code of Criminal Procedure and other following conditions:

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the below, if so required
