In this present case, the petitioners are apprehending their arrest in connection with Tr. No. 947 of 2023 arising out of Indian Forest Case No. 112 of 2016, registered on 01.10.2016 for the offences under Sections 9, 27, 29, 30 31, 39, 44, 49(kh), 51 and 51(c) of the Wild Life Protection Act.

As per prosecution case, the allegation against the petitioners is that they killed a bison and fled away when the forest official reached at the spot on getting credible information about the poachers opening fire and killing protected animals.

Learned counsel for the petitioners submits that the petitioners are quite innocent and have falsely been implicated in this case. No recovery either from person or conscious possession of the petitioners have been shown. The petitioners were not named in the complaint but subsequently, their names transpired in the seizure list which was not prepared by following the proper procedure in this regard. He further submits that it is not clear from complaint or seizure list that the bison was killed by the petitioners as it could have been killed by any wild animal and such animal could have consumed the meat of the bison. Merely on suspicion, the petitioners have been named in this case. The petitioners are having clean

Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioners and submits that the allegation of killing a wild animal is against the petitioners.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the doubtful nature of allegation against the petitioners and possibility of false acquisition, let the petitioners, in the event of their arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1^st Class, Bagaha, West Champaran/concerned court in connection with Tr. No. 947 of 2023 arising out of Indian Forest Case No. 112 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions:
