Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is in custody in connection with Vaishali (Belsar O.P) P.S Case No. 239 of 2023 giving rise to S.T. No. 95 of 2024 registered for the offences punishable under Sections 363 / 494 I.P.C and later on charge-sheet under Section 366 I.P.C.

As per prosecution case, petitioner eloped the victim and her son on pretext of marriage.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner has got no criminal antecedent as stated in para 3 of the bail petition. It is also submitted that

petitioner is in judicial custody since 27.10.2023.

However, learned APP for the State oppose the

prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order it appears that charge-sheet has been submitted by the I.O against the accused petitioner under Section 366 of I.P.C, as submitted by the learned counsel victim is major and petitioner is arrested in house and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, vaishali at Hajipur in connection with Vaishali (Belsar O.P) P.S Case No. 239 of 2023 giving rise to S.T. No. 95 of 2024.
