Heard learned counsel for the parties.

The petitioner apprehend his arrest in connection with Siwaipatii P.S. Case No. 105 of 2023 registered for the offence punishable under Sections 420 of the IPC and Section 22/23 (i) Pro-conception and Pre Natal Diagnostic Techniques Act (PC and PNDT) Act.

As per the prosecution case, the informant, during inspection of the said official, some illegal ultrasound centre including New Divya Ultra Sound, Paigambarpur, Minapur was directed to submit the valid documents of the centre but after lapse of 24 hours none of the proprietor of alleged ultrasound centre submitted any report or documents. It is alleged that in the FIR mentioned ultrasound centre was illegally running by its proprietors.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. The petitioner is not an owner of the said Uttam Ultra Sound rather on negotiation of rent with the land owner for the purpose of online work meanwhile the informant has raided the premises and implicated this petitioner. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seek for regular bail, the learned Court below shall pass the order on the same day in accordance with law.
