Heard learned counsel for the petitioner and

learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sonepur P.S. Case No.746 of 2022 lodged under Section 392 of the I.P.C.

As per the prosecution case, the F.I.R. has been lodged against three unknown accused persons against whom there is allegation of snatching the bag of gold of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner’s name has figured in this case by virtue of confessional statement of the co-accused and nothing incriminating has been recovered from his possession nor he was put on T.I.P.

Counsel further submits that the petitioner is in custody since 29.05.2023 having five criminal case pending against him in which he is on bail.

Counsel also submits that the other co-accused has been granted bail by the Co-ordinate Bench of this Court vide order dated 11.10.2023 passed in Cr. Misc. No. 64727/2023.

Learned counsel for the State opposes the prayer

for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, after framing of charge, if not framed , on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran in connection with Sonepur P.S. Case No.746 of 2022, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.

However, the petitioner shall be granted bail only on being satisfied by the Trial Court that the petitioner is not absconding in any of the cases pending against him whose details are as follows:-

i. Sonepur P.S. Case No. 448 of 2019.

ii. Sonepur P.S. Case No. 959 of 2019.
