Heard learned counsel for the petitioner and

learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner being the husband has been falsely implicated in the present case by the informant. It is further submitted that the daughter of the informant was married to the petitioner on 11.05.1999 and out of the wedlock two children were born. It is next submitted that petitioner is employed with the Jharkhand police and on the date of occurrence also he was at his place of duty. It is also submitted that the deceased at times used to behave abnormally and two days prior to the date of occurrence

had left her home and had gone outside but since the petitioner was not present in the house as he was on duty at Jharkhand as such his children, who were minors, could not inform the petitioner. It is further submitted that both the children are staying with the petitioner and he is in custody since 11.12.2023. It is next submitted that even the informant after coming to know the truth compromised the case. It is also submitted that petitioner will not abscond rather will cooperate in the trial.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the aforesaid submissions, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chapra Mufassil P.S. Case No. 242 of 2010.
