Heard learned counsel for the petitioner and learned

The petitioner seeks bail in connection with Chakand P.S. case No. 359 of 2023 instituted for the offences under Sections 457/380 of the Indian Penal Code.

Prosecution case, in short, is that the petitioner along with other accused persons broke the lock and entered the house of the informant and stole jewellery, cloths and cash Rs. 30,000/-.

Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case merely on the basis of suspicion. No incriminating article has been recovered from the conscious possession of the

petitioner. Learned counsel further submitted that informant is not the eye-witness to the occurrence and the entire story was narrated to the informant by other persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.11.2023 and has no criminal antecedent.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, clean antecedent as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Chakand P.S. case No. 359 of 2023.
