The petitioner is not named in the F.I.R. and his name has surfaced in this case on the basis of the confessional statement of co-accused Sudhir Singh. There is no eye-witness to the alleged occurrence. There is no direct or specific allegation of any overt act against the petitoiner rather the same is general and omnibus in nature. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as has been stated in paragraph no.3 of the present bail application. The petitioner is languishing in judicial custody since 02.09.2023. Charge-sheet has been submitted in this case.
