The present petition is by way of fifth attempt, at the behest of the petitioner, for grant of regular bail, in connection with Dhanarua P.S. Case No.254 of 2016, registered under Section 341, 342, 323, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act, inasmuch as all the earlier petitions, filed by the petitioner for grant of regular bail, have stood rejected.

In pursuance to the earlier order of this Court dated 12.07.2024, a status report has been sent by the learned Court of Additional Sessions Judge-II, Masaurhi,

Patna, dated 18.07.2024, wherein it has been stated that out of nine prosecution witnesses, two have been examined and summons have been issued for examination of rest of the witnesses as also the learned Court would make sincere efforts to conclude the trial of the case within six months.

At this juncture, the learned counsel for the petitioner submits that the petitioner is languishing in custody since 08.06.2016, i.e. since more than eight years, hence a sympathetic view be taken and the petitioner be granted the privilege of bail.

This Court finds that since the learned trial court has sought six months’ time to conclude the trial, it would be appropriate to grant liberty to the petitioner to renew his prayer for bail, after lapse of six months from today, in case there is no substantial progress in the ongoing trial.

In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to renew the prayer for grant of regular bail, after lapse of six months from today, in case there is no substantial progress in the ongoing trial. Liberty so sought is granted.
