In this case, the appellants are seeking regular bail in

connection with Obra P.S. Case No. 28 of 2024 registered for the offences punishable under Sections 365 and 363 of the Indian Penal Code and added Sections 302/34 of the Indian Penal Code.

As per allegation, the informant’s son gone with the appellants to eat samosa but he did not return home. On search, he was not traced out.

The learned counsel for the appellants have submitted that there is no more evidence at all against the appellants and all the appellants were friends of the deceased and the F.I.R. reveals itself that there was no enmity between them. It has also been submitted that no external injury was found on the dead body and it was detected in the postmortem that the deceased died due to drowning. The appellants are the persons of clean antecedent and they are under custody since 25.01.2024.

On the other hand, learned counsel for the informant opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, let the appellants above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Judge, SC/ST Act, Aurangabad in connection with Obra P.S.
