The petitioner seeks regular bail in connection with

Sessions Trial No. 319 of 2023 arising out of Mirganj P.S. Case No. 185 of 2022 dated 30.12.2022, lodged under Sections 341, 323, 398A and 304B of the I.P.C. read with Sections 3 and 4 of the D.P. Act.

As per the prosecution case, the deceased died due to the torture mated out to her by the petitioner and others. The deceased and the petitioner have two infants.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the deceased has committed suicide and in-laws of the petitioner were informed about the same. He further submits that the two infants are living with the family of the petitioner

and they will suffer if the father will not be there to look after them, as the mother has also died. He further submits that the petitioner is in custody since 01.03.2023.

Learned A.P.P. for the State opposes the prayer for

bail.

Learned counsel for the informant vehemently opposes the prayer for bail and submits that the deceased was killed by the accused persons.

Considering the facts and circumstances of the case, this bail application is allowed.

Let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Purnea in connection with Sessions Trial No. 319 of 2023 arising out of Mirganj P.S. Case No. 185 of 2022, subject to the conditions that the petitioner shall support in trial and shall appear physically either himself or through his lawyer before the lower court on each and every date fixed. In case of non-appearance for two consecutive dates without sufficient cause, shall be resulted into cancellation of his bail bond.
