Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Shahkund P.S. Case No. 399 of 2022, registered for the offences punishable under Sections 147, 149, 341, 323, 307, 354, 504, 506, 448, 427 and 397 of the Indian Penal Code.

As per allegation, the accused persons came to the house of the informant, abused and assaulted her. When her husband objected, they also assaulted him with Lathi , Paina and iron rod. The offshoot behind the occurrence was that the accused wants to grab her land and property.

The learned counsel for the petitioner has submitted that the parties are agnates. There is land dispute between them and the injuries are simple in nature.

On the other hand, Sri Shalendra Kumar, learned Additional Public Prosecutor has opposed the prayer for bail and submitted that the petitioner is direct assailant.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-VIII, Bhagalpur in connection with Shahkund P.S. Case No. 399 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
