Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Ishakchak P.S. Case No. 156 of 2020 registered under Sections 302/34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to political rivalry and previous enmity. Further submission is that petitioner is not named in the first information report. One more case of similar nature was lodged by the informant’s side bearing Ishakchak P.S. Case No. 155 of 2020, in which, petitioner has already been granted bail by this Court vide Cr. Misc. No. 39643 of 2021 on

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 156 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
