2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Khagaria (Muffasil) P.S. Case No. 22 of 2023, G.R. No. 55 of 2023 dated 08.01.2023 registered for the offences punishable u/s 414 of the Indian Penal Code.

4. As per the prosecution case, a Bolero pick up van bearing No. BR 09R 0635 and Engine No. GHE IF 38340 of a pick up van were seized from kawarhi khana of the co-accused Pritam Kumar. On inquiry, Mithlesh Kumar came and produced photocopy of Suryagarh P.S. Case No. 402/2022 regarding

stolen Bolero Pick up vehicle bearing Reg. No. BR 53A 7251 and its engine no. GHE IF 38340 which is the same engine that was seized earlier as it has the same engine no. The vehicle No. BR-09R-0655 belongs to Munna Singh. The stolen body(dala) of the vehicle was fixed in other vehicle after cutting by the coaccused Pritam Kumar and Munna Singh.

5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner is bonafide owner of the alleged Pick Up van bearing No. BR09R/ 0635 and he has purchased the said Bolero vehicle from the original owner namely, Md. Chamo, Sahebpur Kamal on 12.11.2022 and got transferred it in his name. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned,
