The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 302, 120(B), 34 of the Indian Penal Code.

As per prosecution case, two unknown miscreants, riding on motorcycle, committed murder of the maternal uncle of the informant. Petitioner is the first wife of the deceased.

Learned counsel for the petitioner submits that the petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that the name of the petitioner transpired during investigation when the police came to know about some property dispute between the petitioner, her son and the deceased. He submits that there is no specific overt act against the petitioner and only on suspicion she has been

made accused in this case. He submits that similarly situated coaccused has already been granted bail by a coordinate Bench of this Court vide order dated 12.05.2023 passed in Cr. Misc. No. 8203 of 2023. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Considering the facts and circumstances of the case, let the above named petitioner in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Forbesganj P.S. Case No. 84 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
