Heard the parties.

The petitioner apprehends his arrest in a case registered for the offence punishable u/s 384, 379, 427, 323,341, 504, 506, 147, 148, 149 of the IPC.

As per prosecution case, F.I.R. named accused persons including the petitioner, armed with gun came alongwith JCB machine and demolished the boundary wall and water tank of one Rajmangal Prasad and abused the care taker. They demanded ransom money of Rs.60,00,000/- and threatened to not construct the house. It is further alleged that the petitioner and other accused persons theft the CCTV camera and other articles of his house.

that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to village politics. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. There is a land dispute between the parties and for which a Title suit is pending before the learned court below. The petitioner has eight criminal antecedent and he is aged about 62 years.

Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, since there is land dispute between the parties, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Vishnupad P.S. Case No.192/2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
