Heard learned counsel for the petitioner and the
learned A.P.P. for the State.
The petitioner apprehends his arrest in connection
with G.O. Case No. 607(A) of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. Further he submits that from perusal of seizure list, it appears that the illicit liquor has been recovered from the side of the canal.
Having considered the facts and circumstances of
the case, let the above named petitioner be released on bail, in
Patna High Court CR. MISC. No.32365 of 2022(3) dt.03-01-2023 2/2
the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Nawada in connection with G.O. Case No. 607(A) of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
