Heard learned counsel for the petitioner and the

State.

Petitioner apprehends arrest in a case registered for the offence punishable under Sections 498(A), 406, 420, 323, 379, 307, 504, 506, 149 of the IPC.

As per the prosecution case, all the accused persons including this petitioner, in collusion with each-other, got opened a bank account in the bank and fraudulently withdrawn money taking her in good faith and grabbed the money of compensation of Rs. 1,82,000/- of the husband of the complainant and lastly they ousted the complainant from matrimonial home retaining her belongings.

It is submitted on behalf of the petitioner that till date

the son of the complainant is living with his grand parents and complainant never came to see her child. She has not usurped the money and ready to refund the amount to the complainant.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Shiv Shrutika, learned J.M. 1^st Class, Gopalganj in connection with Complaint Case no. 470/2021 corresponding Trial No. 2307/2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure and petitioner is directed to return the amount of compensation to the complainant in two installments within six months from the date of the order of this court.
