Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner apprehends arrest in connection with Bahera P.S. Case No. 295 of 2021 registered for the offence under sections 467, 468 and 471 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from near a tree by the side of Simaghat Road, which is an open place, as is evident from the seizure list enclosed as Annexure-7 to the
Patna High Court CR. MISC. No.28153 of 2022(3) dt.10-01-2023 2/2
supplementary affidavit.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judgte, Excise II, Darbhanga in connection with Bahera P.S. Case No. 295 of 2021 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
