The petitioners have prayed for bail in a case instituted for the offence under Sections 147, 148, 149, 323, 324, 325, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

This is the second attempt of prayer of bail by these petitioners, earlier their prayer was rejected vide order dated 21.04.2022 passed in Cr. Misc. No. 21043 of 2021.

The allegation against the petitioners along with others is of killing the brother-in-law ( Bhaisur ) of the informant and brutally assaulted the Devar of the informant due to which he sustained injury.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioners on bail and, as such, their prayer for bail stands rejected.

From the perusal of the trial Court report, which is Marked at Flag ‘B’, it appears that the trial shall be concluded within a period of one year.

Hence, the trial Court is directed to conclude the trial positively within six months failing which, the petitioner will be at liberty to renew their prayer for bail.
