Heard learned counsel for the petitioners and the

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 324, 307 and 504 of the Indian Penal Code and section 67 of the Information Technology Act.

As per the prosecution case, petitioner no. 2 is alleged to have made viral the photograph of informant’s sister with indecent remarks on the Facebook. Petitioner no. 1 is alleged to have inflicted Farsa blow over the head of one Vijay Pratap causing head injury.

Facebook, it has come during course of investigation that one Satendra Chauhan, s/o of Babu Ram Chauhan, resident of 10, Jangal Belawa, Jangal Aamawa, Padraunia, Kushinagar, Uttar Pradesh, having mobile no. 9350759368 made viral the photograph of informant’s sister with indecent remarks. It is further submitted that there is general and omnibus allegation of abuse and assault and no specific overt act has been alleged against these petitioners. Injury caused by petitioner no. 1 is simple in nature. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Dhanaha P.S. Case No. 239 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
