A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 447, 341, 323, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleges that that on 17.01.2022, at 9:00 pm, while she was going to sleep when the named accused persons including the petitioner and 8-10 unknown persons entered her house and started indiscriminate firing in order to kill her but she somehow saved her life, it is next alleged that the accused persons had come to kill her daughter-in-law, it is further alleged that on 29.08.2004, accused persons had killed her husband and son for which a case was registered under

Section 302 of the IPC read with Section 27 of the Arms Act in which Chandramani Singh and Nagmani Singh were held guilty and presently are on bail. It is next alleged that the reasons for the present occurrence was that wife of Chandramani Singh was defeated in the election of Mukhiya.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent. Learned counsel next submits that the petitioner has been falsely implicated in the present case, it is next submitted that the petitioner was not an accused in the case which was instituted in the year 2004, it is further submitted that though the allegation is of indiscriminate firing but then no one was injured, it is thus submitted that on account of dispute relating to election and previous enmity with Chandramani Singh and Nagmani Singh, the present case came to be instituted in which the petitioner was also implicated without any specific allegation.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on

anticipatory bail on furnishing bail bonds of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Khagaria (Muffasil) P.S. Case No. 65 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
