Heard learned counsel for the petitioner and learned Additional Public Prosecutor (for brevity, APP ) appearing for the State of Bihar.

The petitioner has preferred this application for grant of regular bail in connection with Mansi Police Station (for brevity, PS ) Case No 262 of 2019 dated 27.11.2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 of Indian Penal Code and Section 27 of Arms Act.

As per prosecution case, the petitioner and the co-

accused persons arrived in the field of the informant where the field was being ploughed by tractor. The petitioner and the coaccused persons assaulted the informant with lathi, danda and restrained her from ploughing the field. They also assaulted the driver of the tractor. It is further alleged that the co-accused persons fired with pistol which hit the left hand and left leg of Pancha Singh. Consequently, he fell down. The reason behind the occurrence is stated to be land dispute.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is a counter blast case. The petitioner has no criminal antecedent as stated in paragraph 3 of the bail petition. The coaccused Bijendra Singh has already been granted bail by the coordinate Bench of this Court vide order dated 28.04.2023 passed in Cr Misc No 66073 of 2022. The petitioner is in custody in this case since 19.10.2022. It is further submitted that the injuries have been inflicted on non-vital part of the body.

Learned APP has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation

against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01^st Class, Khagaria in Mansi PS Case No 262 of 2019 dated 27.11.2019.
