Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Forbesganj P.S. Case No. 496 of 2020 corresponding to Spl. Case No.- 05/2020 dated 24.06.2020 registered for the offences punishable under Sections 20 and 22 of the N.D.P.S Act.

As per the prosecution case, total 1.7kg ganja, Rs. 2,78,750/- , Nepali currency of Rs. 1,780/- and a mobile phone were recovered from the house of the co-accused Suresh Das and one co-accused Raman Kumar Das was arrested who

disclosed that the petitioner and the co-accused persons are involved in an illegal business of ganja .

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The recovery was made from the house of the co-accused. The petitioner is accused in two other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 13.01.2023

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Araria in connection with Forbesganj P.S. Case No. 496 of 2020 corresponding to Spl. Case No.- 05/2020.
